Who Is Responsible?

Every day in landscaping feels like a new episode of a TV show. I’ll meet a homeowner in Seattle, then someone in Bellevue, then someone in Issaquah. They all have their own lives and their own stories, and for a brief moment—sometimes just during an estimate—I’m part of one.

I’m not saying I’m the hero of the show. I’m just the guy who keeps showing up with a landscaping truck.

The funny thing is how often the same character appears in these stories: blackberry. Doctors have blackberry. Tech workers have blackberry. Grandparents have blackberry. People in townhouses have blackberry, and people on big properties have it too.

One of the most frustrating versions is blackberry coming over a neighbor’s fence. The homeowner calls us because the canes keep reaching into their yard, and they’re tired of cutting them back. They want to know: whose job is this?

Here’s the practical answer I give them: you can manage the growth that has reached your side of the property line. Start by talking to your neighbor if you can, especially if you want the whole patch removed. Don’t assume you can send a crew into their yard or dig out the source without their permission.

Blackberry infestation, Kemore WA

I want to be careful with the word responsible, though. Blackberry crossing your fence does not automatically mean you’re legally responsible for the entire infestation or that your neighbor automatically has to pay your removal bill. In Seattle, vegetation growing between two private properties is generally a matter for the property owners to resolve. King County also does not require property owners to control Himalayan blackberry simply because it is growing on their land. Rules may differ if growth blocks a public sidewalk or street.

That may not be the answer you want when you’re standing there looking at a wall of thorns. I get it. I’ve met people who have dealt with a neighbor’s blackberry for years. We’ve cleared patches so tall and dense that it was hard to believe they started as a few canes.

It’s easy to look over the fence and think, Why won’t they just take care of it? Maybe they don’t care. But maybe they’re short on money, caring for someone, dealing with their own health, or physically unable to do the work. We usually don’t know the whole story.

And blackberry removal is real work. Cutting the canes is one part. Then there’s digging, loading, hauling, disposal, and coming back to deal with regrowth. You either spend your time doing it or pay someone with the crew and hauling capacity to do it. Sometimes neither option is easy for the people involved.

So I’d start with a conversation. Show your neighbor where the blackberry is coming through and ask whether they want to tackle the patch together. If they agree to work on their side, great. If they don’t, you can still make a plan for your own yard. That may mean cutting back the canes regularly or clearing the section you can reach and watching for new growth.

I’ve seen how much a neighboring property can affect someone’s experience of their own yard. A fence falls down. Blackberry takes over a hedge. A homeowner moves into their dream house and discovers roosters next door. Sometimes you have to laugh for a second, even when the problem is genuinely stressful.

You can’t control every plant beyond your fence, and you can’t control how your neighbor spends their time or money. You can decide what to do on your side, ask for cooperation, and be realistic about the work it will take.

Field note: If your neighbor’s blackberry is reaching over the fence, talk to them before planning work on both properties. Clear and maintain what you can on your side. A shared effort can get closer to the source of the problem, but even a thorough cleanup needs follow-up when blackberry starts growing again.

Every day in landscaping feels like a new episode of a TV show.
